General Terms and Conditions

By registering as a client with Studio 41 Pilates (‘Studio 41’) and signing this agreement, you confirm that you have read, understood, and accepted the terms outlined below.

Definitions

‘Class’ – Any group class, whether purchased individually, as part of a package, or included in a membership, offered by Studio 41.

‘Package’ – A set of prepaid classes with a defined expiry date.

‘Membership’ – An automatically renewing monthly agreement with specific benefits.

‘Session’ – Any private 1:1 or duet class, whether purchased individually, as part of a package, or included in a membership

  1. Booking & Payment

    All classes / sessions must be booked in advance via the Momence app or our website.

    Payment must be completed before your booking is confirmed.

    You may download the Momence mobile app from the App Store or Google Play to manage bookings, cancellations, and communications.

  2. Minimum Attendance

    A class requires a minimum of two (2) participants to run.

    If fewer than two people are booked, we may:

    Offer an upgrade to a Private Duet or 1:1 session for an additional fee, or

    Reschedule your booking.

    Any changes will be communicated at least 4 hours before the class start time via the Momence app or email.

    If a class is cancelled by Studio 41, your class credit will be returned.

  3. Class Length & Arrival

    Standard class duration is 55 minutes unless otherwise stated.

    Please arrive at least 5 minutes before the start time.

    Clients arriving more than 15 minutes late may be refused entry, and the session will be counted as used.

  4. Waitlist Policy

    You may join the waitlist for a fully booked class.

    By joining the waitlist, you agree to attend if a place becomes available

    If a place opens, you will be automatically booked up to 60 minutes before the class starts and notified by email.

    Please ensure notifications are enabled in Momence to receive updates.

     

  5. Purchase & Validity

    Intro Offer (3 Private Sessions): available to new clients only, one per person, non-refundable, non-transferable, activates on the purchase date.

    Gift Cards: valid for classes or products only, non-refundable, non-transferable, no cash redemption, cannot be combined with other offers, no extension for change of mind, illness, or relocation.

    Validity Periods:

    1. Single class (group or private): 30 days from purchase

    2. 10 Private Class Package: 180 days from purchase

    3. 10 Group Class Package: 120 days from purchase

    4. Monthly Membership: 1 month from purchase date

    5. Intro Offer: 1 month from purchase date

  6. Online Purchases & Danish Consumer Law
    Under Danish law (Forbrugeraftaleloven), you may cancel online purchases within 14 days. By booking a class, package, or membership to start during this period, you agree that Studio 41 may begin providing the service immediately. Once you attend your first class or start using your membership/package, the purchase becomes non-refundable.All purchases are for personal use only and cannot be shared or transferred.

  7. Cancellations by Clients

    To ensure fairness for all:

    Cancellations must be made through your Momence account. We cannot accept cancellations by email, phone, or social media.

    Cancel up to 24 hours before the start time: no penalty.

    Cancel less than 24 hours before: class deducted from package/membership.

  8. Cancellations by Studio 41

    We may cancel or reschedule if the instructor is unavailable and no substitute is possible.

    You will be notified as soon as possible, and your session will not be deducted.

    In the event of force majeure (e.g., government restrictions, extreme weather), classes may be rescheduled or packages extended.

     

  9. Health & Safety

    By attending any in-person or online class, workshop, or event:

    You confirm that you are physically and mentally fit to participate.

    You will follow all safety instructions from the instructors.

    You will inform us immediately of any health changes, including pregnancy.

    Pregnant or postpartum clients must have clearance from a healthcare provider before attending.

     

  10. Liability

    Studio 41 will not be liable for injury, illness, or property damage except in cases of gross negligence or wilful misconduct.

    We are not responsible for clothing, footwear, or personal belongings.

    Participation in physical exercise carries inherent risks, and you are responsible for ensuring you are fit to participate.

    Studio 41 reserves the right to change schedules, instructors, or equipment when necessary, with reasonable notice.

     

  11. Personal Data

    Your personal data is handled according to our Privacy Policy in compliance with GDPR.

    By registering, you consent to our use of your information for booking, communication, and payment purposes.

  1. Membership Overview

  • The Monthly Membership ‘Essential’ provides 8 group classes of your choice during the membership validity period.

Exclusions: Classes taught by teachers in training and discounted classes.

Not included: Workshops, challenges, courses, and private sessions.

The membership is personal and non-transferable.

  • The Monthly Membership ‘Essential Plus’ provides 10 group classes of your choice during the membership validity period.

Exclusions: Classes taught by teachers in training and discounted classes.

Not included: Workshops, challenges, courses, and private sessions.

The membership is personal and non-transferable.

1.1 Monthly Membership ‘Essential Plus’ Benefits:

10% discount on 10-Class Pass and Packages of 10 Private or Duet sessions.

10% discount on selected workshops and events.

10% discount on products sold at the studio shop.

4 Guest Passes per 12-month membership period:

    • Each pass is for 1 person only.

    • Passes can be used once every 3 months.

    • Guest passes are available after the completion of each 3-month period.

    • Guests must not be current or previous clients.

    • Each of the 4 passes must be used for 4 different people; the same guest cannot be invited more than once.

    • The 12-month period starts from the membership start date, not the calendar year.

    • Requests should be made via info@studio41pilates.com.

2. Membership Duration and Renewal

  • The membership runs for one (1) month from the date of purchase.

  • It will auto-renew monthly using the card on file.

  • Payments will continue until you provide a notice of termination.

  • No cancellations are allowed during the first 3 months (initial term + 2 renewals).

  • Unused classes do not roll over.

  • Refunds, exchanges, or transfers are generally not offered, except where required by Danish consumer law (e.g., if Studio 41 cannot provide the purchased classes).

3. Failed Membership Payments

The client agrees to maintain sufficient funds for autopay.

If a payment fails, the renewal will be retried 3 times:

  • 1 day after the failed payment

  • 2 days after the first retry

  • 2 days after the second retry

If payment cannot be received after 3 attempts, the outstanding amount may be sent to a debt collection agency.

4. Membership Suspension (Freeze)

After the initial 3-month minimum term, members may request to suspend their membership for personal or travel reasons:

  • Maximum suspension: 6 weeks per 12-month membership period, split into no more than two separate periods.

  • Minimum suspension period: 1 week.

  • Requests must be submitted in writing via email at least 14 days before the suspension start date.

  • During suspension:

    • No class credits are issued

    • No membership fees are charged

    • Renewal date extended by the suspension length

  • Membership cannot be cancelled during suspension. Cancellation notice must be given after the suspension ends.

5 Cancellations by Clients

By participating in any Studio 41 class, workshop, or event, you acknowledge the inherent risks of physical activity and equipment use. You confirm that:

  • You are physically and mentally fit to participate.

  • You will follow all instructions for safe equipment use.

  • You will inform your instructor of any health changes, including pregnancy.

  • If pregnant or postpartum, you have healthcare clearance to attend.

8. Liability

  • Studio 41 is not responsible for unavailable sessions, instructors, or equipment.

  • Studio 41 may make reasonable alterations to sessions, instructors, equipment, or terms and conditions.

  • Studio 41 is not responsible for clothing, footwear, or personal items, nor for injuries or damages, except in cases of gross negligence or willful misconduct.

  • Participation in physical exercise carries inherent risks. Clients are responsible for ensuring they are fit and able to participate.

9. Data Protection

  • Studio 41 complies with GDPR. Personal data, including payment details, will be stored securely and only used for membership management and communication.

  • Clients may request access, correction, or deletion of their personal data at any time.

10. Force Majeure

  • Studio 41 is not liable for delays or failure to provide services due to events beyond its control, including natural disasters, illness, pandemics, or technical failures.

  • Affected classes may be rescheduled or credited at Studio 41’s discretion.

11. Changes to Terms & Pricing

  • Studio 41 may update these terms or membership fees.

  • Clients will be notified via email or posted on the Studio 41 website at least 30 days in advance.

  • Continued membership after notification constitutes acceptance of the new terms or pricing.

12. Dispute Resolution and Governing Law

  • These terms are governed by Danish law.

  • Any disputes will first be attempted to resolve amicably. If unresolved, disputes may be submitted to Danish courts.
